Terms of Service

1. Acceptance of Terms

By accessing or using RC Agents ("the Platform"), operated by Chabni Reda-El-Mustapha ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to all terms, do not access or use the Platform.

These terms apply to all merchants, store owners, and end customers who interact with the Platform through any channel, including but not limited to the website at rcagents.space, API integrations, Facebook Messenger, WhatsApp, Instagram, and Live Chat.

2. Service Description

RC Agents is a multi-tenant SaaS platform that provides:

• AI-powered customer support agents across multiple messaging channels
• Multi-store management dashboard with real-time analytics
• Order management, tracking, and shipping integration
• Product catalog and inventory synchronization with Shopify
• Customer relationship management and communication history

3. Account Registration and Responsibilities

3.1 Merchant Accounts

To use the Platform as a store owner, you must complete the onboarding process and provide accurate, current, and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Ensuring compliance with applicable laws regarding your store and products
• Obtaining necessary consents from your customers for data processing

3.2 Subdomain Allocation

Upon onboarding, you will receive a subdomain on rcagents.space (e.g., yourstore.rcagents.space). You are responsible for the content and activities conducted on your subdomain. We reserve the right to suspend or remove subdomains that violate these terms.

4. Platform Rules and Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable law
• Sell, resell, or sublicense access to the Platform without our written consent
• Interfere with or disrupt the integrity or performance of the Platform
• Attempt to gain unauthorized access to other accounts, systems, or networks
• Use the Platform to distribute spam, malware, or harmful content
• Reverse-engineer, decompile, or disassemble any part of the Platform
• Use AI responses to generate harmful, discriminatory, or misleading content

5. AI Agent and Automated Responses

RC Agents uses artificial intelligence to generate automated responses to customer inquiries. By using the Platform, you acknowledge and agree that:

• AI responses are generated based on available product data and training and may contain errors
• You retain the ability to intervene and manually override AI responses at any time
• You are ultimately responsible for all communications sent through your account
• We do not guarantee the accuracy, completeness, or appropriateness of AI-generated responses
• You should review and configure the AI system prompt to align with your brand voice and policies

6. Fees and Payments

6.1 Subscription Plans

The Platform is offered under different subscription plans (Starter, Growth, Enterprise). Fees for each plan will be clearly displayed at the time of subscription. We reserve the right to modify pricing with reasonable notice.

6.2 Free Tier

The Starter plan is currently offered free of charge with limited features. We may modify or discontinue the free tier at any time with notice.

6.3 Payment Terms

Paid subscriptions are billed in advance on a monthly or annual basis. Refunds are provided on a case-by-case basis. Non-payment may result in suspension or termination of access.

7. Intellectual Property

The Platform, including its design, code, branding, and underlying technology, is owned by Chabni Reda-El-Mustapha. You retain ownership of your store data, product information, and customer relationships. You grant us a limited license to use your store data to provide and improve the Platform services.

8. Third-Party Services and Integrations

The Platform integrates with third-party services including:

• Shopify: For product and order synchronization
• Meta (Facebook, Instagram, WhatsApp): For messaging and customer communication
• ZR Express: For shipping and delivery services
• DeepInfra / AI Providers: For AI model inference

Your use of these third-party services is subject to their respective terms and policies. We are not responsible for the acts or omissions of third-party service providers.

9. Limitation of Liability

To the maximum extent permitted by law, RC Agents and its operator shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or business opportunity
• Damages arising from AI-generated content or automated responses
• Service interruptions due to third-party provider downtime
• Any damages exceeding the fees paid by you in the 12 months preceding the claim

10. Termination

Either party may terminate the agreement at any time with written notice. Upon termination:

• Your access to the Platform will be revoked
• Your data will be retained for 30 days for retrieval, then permanently deleted
• Outstanding fees remain payable
• Sections 7, 9, 10, and 11 survive termination

We may suspend or terminate access immediately for violation of these terms or applicable laws.

11. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the People's Democratic Republic of Algeria. Any disputes arising from these terms shall be resolved through amicable negotiation first, and if unresolved, through the courts of Tlemcen, Algeria.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or platform notice. Continued use of the Platform after changes constitutes acceptance of the modified terms.
